Abstract

This study aims to reconstruct the concept of gender justice in Islamic inheritance law through a normative and empirical approach applied to contemporary Muslim communities in Indonesia. Normatively, Islamic inheritance law is often understood literally based on provisions in the Qur’an that establish a 2:1 ratio between men and women. However, in contemporary social practice, various forms of adaptation, negotiation, and even deviations have been observed, indicating a dynamic interpretation of gender justice. This study employs a normative legal methodology combined with an empirical approach through literature review and analysis of social practices. The results show that justice in Islamic inheritance law is not merely distributive in nature but is also contextual and oriented toward the maqāṣid al-syarī‘ah, particularly the protection of justice and the public interest. Therefore, a reconstruction of the understanding of Islamic inheritance law is needed one that is more responsive to the principle of gender justice without disregarding the authority of normative texts.
