Analisis Yuridis Pengarsipan Elektronik Dokumen Pertanahan dalam Mewujudkan Kepastian Hukum Pertanahan

Abstract

The development of information technology has encouraged the transformation of land administration systems through the implementation of electronic-based services, including the management of electronic archives of land documents. Electronic archiving plays an important role in ensuring the availability, security, and validity of land documents as a basis for realizing legal certainty of land rights. This research aims to analyze the legal regulation of electronic archiving of land documents and examine its role in realizing legal certainty in Indonesian land administration. This study uses normative legal research with statutory and conceptual approaches. The legal materials were obtained through literature studies involving primary legal materials, secondary legal materials, and relevant academic references. The results show that electronic archiving of land documents has a legal basis through regulations concerning agrarian law, archives, electronic information and transactions, and electronic land services. However, the regulation of electronic archiving remains fragmented and has not comprehensively regulated technical aspects, data security, authentication mechanisms, and legal responsibility in electronic document management. Electronic archiving contributes to strengthening legal certainty by improving the accuracy, accessibility, and integrity of land data. Nevertheless, the effectiveness of electronic archiving requires regulatory harmonization, reliable information systems, adequate infrastructure, and competent human resources. This research implies the need for strengthening the legal framework and governance of electronic land document archiving to ensure that digital transformation in land administration provides optimal legal protection for land rights holders.
