Abstract

Islamic Civil Law plays a significant role in resolving marital disputes, particularly in countries with a majority Muslim population. This paper examines the fundamental principles of Islamic civil law as a foundation for resolving marital disputes, including the role of judges, mediation, and the enforcement of Sharia law. The study employs a qualitative approach by analyzing legal documents and scholarly fatwas. The findings indicate that Islamic civil law provides a comprehensive framework for addressing issues such as divorce, alimony, child custody, and asset distribution. Understanding the principles of Islamic civil law enables dispute resolution to be carried out fairly and in accordance with Sharia values.
