PERAN ADVOKAT DALAM PENEGAKAN HUKUM DAN HAK ASASI MANUSIA TERHADAP DUNIA PERADILAN PIDANA DI INDONESIA

Abstract

In the world of courts, law enforcement efforts must be implemented and carried out fairly without intimidation and discrimination against victims and even against perpetrators of crimes, because this concerns human rights. Human rights are rights that must be protected by every country from the womb of a mother until her death. So that when someone faces the world of court (faces the law) whether he is a victim or even if he is a perpetrator of a crime, he still has the right given by the state to defend himself. Thus was born the profession of advocate who has a role and plays a very important role in law enforcement in the world of criminal justice, especially in Indonesia. So that human rights are protected and maintained so that they continue to get justice as fairly as possible. Advocates are one of the professions that work in the field of law to provide legal services to individuals or legal entities (clients) who need legal assistance both inside and outside the court. In various countries this profession is officially regulated, including in Indonesia which refers to Law Number 18 of 2003 concerning Advocates. The 1945 Constitution is the highest law in Indonesia that highly upholds human rights. so that in enforcing law and human rights in Indonesia will never be separated from the constitution.
