The acceleration of National Strategic Projects (PSN) in Indonesia marginalizes Indigenous Communities (MHA) due to legal monism, which requires Local Regulation as a prerequisite for customary land rights. Consequently, customary territories without Local Regulation may be claimed as state land. This article examines legal protection and accessibility to justice for MHA in PSN land acquisition, institutionalization of Indigenous Constitutionalism through comparative and case studies, and its role as an instrument of remedial justice. This study employs normative legal research using statutory, conceptual, comparative, and case approaches. The findings indicate that Indonesian law remains inadequate in protecting MHA, as reflected in disputes involving the Balik Tribe in Sepaku and Rempang Eco-City. Comparisons with the Philippines, Malaysia, Australia, and Canada support the declaratory nature of indigenous rights preceding state recognition. This article recommends declaratory constitutional interpretation, an Adat State Tribunal, free, prior, and informed consent as a veto right, and ecological restitution.
