Abstract

This study examines the legal considerations used in the Surabaya High Court Decision Number 56/PID.SUSTPK/2024/PT SBY regarding a corruption case involving an employee of PT INKA Multi Solusi. The study focuses on analyzing the fulfillment of the elements of corruption and the application of the provisions of Law Number 31 of 1999 as amended by Law Number 20 of 2001. Furthermore, this study examines the legal basis for the panel of judges in upholding and reassessing the first instance court decision. The research method used is a normative method with a statutory regulatory approach and a case study approach. The results indicate that the panel of appellate judges considered the elements of an unlawful act and abuse of authority.
