Kedudukan Hukum Perkawinan Adat Lampung dalam Sistem Hukum Nasional

Abstract

The traditional marriage of the Lampung community represents a form of local wisdom that embodies moral, social, and religious values passed down through generations. Within Indonesia’s national legal system, the practice of customary marriage requires examination to ensure its compatibility with positive law, particularly Law No. 1 of 1974 on Marriage and its implementing regulations. This study aims to analyze the legal status of Lampung customary marriage within the national legal framework by reviewing its legality, normative synchronization, and the social function of customary law. The research employs a normative juridical approach supported by interviews with traditional Lampung leaders to obtain empirical insights into the implementation and symbolic meaning of customary marriage. The findings reveal that Lampung customary marriage is recognized as long as it does not contradict national law or religious principles. The values upheld in the tradition such as mutual cooperation, respect for family, and social responsibility enrich the national legal system. Therefore, maintaining synergy between customary and national law is essential to achieving a balance between legal certainty, justice, and the preservation of local culture.
