Pendekatan Fiqih Jinayah terhadap Isu Kejahatan Seksual: Analisis Normatif dan Sosiologis

Sexual crimes are among the most severe violations of human dignity, not only harming the victims but also profoundly affecting the social fabric of society. In the context of Islam, fiqh jinayah provides a clear normative framework for sanctioning perpetrators of sexual crimes, including adultery (zina), rape, and sexual harassment. However, a purely normative approach often fails to adequately address the social and psychological complexities experienced by victims in contemporary contexts. This article aims to analyze the fiqh jinayah approach to the issue of sexual crimes from both normative (based on scriptural texts and scholarly opinions) and sociological perspectives (in relation to modern societal realities). The method employed is a literature review using an analytical qualitative approach. The results of the analysis indicate that fiqh jinayah emphasizes substantive justice and prevention through strict legal punishment, yet its implementation requires contextual reinterpretation that considers victim protection, fair evidentiary procedures, and efforts for social rehabilitation. Integrating normative and sociological approaches is essential in formulating a more comprehensive and applicable Islamic legal response to sexual crimes in the modern era.
